Tonation Terms of Service

  1. Agreement

    These Terms of Service ("Terms") constitute a legally binding agreement ("Agreement") between you ("you") and Tonation ("Company"), governing your access and use of the Company's website https://tonation.me, including any subdomains (collectively, the "Site"), and all related services (collectively, the "Tonation Services"). The Site and Tonation Services are hereinafter collectively referred to as the "Tonation Platform".

    The collection and use of personal data by the Company in connection with your access to and use of the Tonation Platform are described in our Privacy Policy, incorporated by reference into this Agreement and located at https://tonation.me/privacy-policy.

    PLEASE READ THIS AGREEMENT CAREFULLY. BY REGISTERING, ACCESSING, BROWSING, DOWNLOADING MATERIALS, OR USING THE TONATION PLATFORM, YOU (A) ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO THE TERMS OF THIS AGREEMENT, AND (B) HEREBY CONFIRM THAT YOU ARE OF SUFFICIENT AGE FOR SUCH REGISTRATION IN ACCORDANCE WITH APPLICABLE LAW AND/OR THAT YOU HAVE ALL NECESSARY CONSENTS (E.G., PARENTAL CONSENT) IN FULL COMPLIANCE WITH APPLICABLE LAW, INCLUDING CONSENT FOR THE PURPOSES OF INFORMATION PROTECTION LAW, OTHERWISE REGISTRATION ON THE TONATION PLATFORM AND ITS USE ARE PROHIBITED.

  2. Scope of Services

    The Tonation Platform is an online platform that:

    • allows registered users ("Streamers") to use its available functionality to communicate with other users who view real-time video content posted by the Streamer on the Internet ("Users", and such Streamer content is "Streamer Content") and receive monetary donations from such Users intended to support the Streamers ("Donations"), and
    • allows Users to make Donations to Streamers and communicate with Streamers in any ways available through the Tonation Platform, including sending text or voice messages, graphic images, or other materials; all content created or uploaded by Users using the Tonation Platform is referred to as "User Content".

  3. Payments and Donations

    All donations on the Tonation platform are processed through smart contracts on the TON blockchain. Smart contracts are publicly verifiable.

    The platform fee depends on the monthly income of the Streamer and is as follows:

    • 8% for income from 0 to 999 USD
    • 7% for income from 1,000 to 7,999 USD
    • 6% for income from 8,000 to 19,999 USD
    • 5% for income of 20,000 USD and above.

    This fee is automatically withheld by the smart contract at the time of the donation.

    Donations are accepted in the following tokens:
    - TON (the native currency of The Open Network)
    - Jettons (TON-based tokens approved by the platform)

    Due to the nature of blockchain transactions, all donations are final and irreversible after confirmation on the blockchain.

  4. Streamer Account

    You must register an account ("Account") to access and use the appropriate functionality of the Tonation Platform designed for Streamers.

    To open an Account, you need to provide the Company with certain information, such as the account name, TON network wallet address, or other information.

  5. Liability and Limitations

    TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE COMPANY IS NOT LIABLE FOR:

    • Loss of funds due to improper use of cryptocurrency wallets
    • Losses related to cryptocurrency exchange rate fluctuations
    • Issues arising from malfunctions in the TON blockchain
    • Loss of access to cryptocurrency wallets
    • Errors when sending transactions to incorrect addresses
